having considered, at a hearing on 6 March 2019 – in the presence of the Sejm, the Public Prosecutor-General and the Polish Ombudsman – a question of law referred by the Circuit Court in Szczecin as to whether:

Article 25(1b) of the Act of 17 December 1998 on Old-Age and Disability Pensions from the Social Insurance Fund (Journal of Laws – Dz. U. of 2016 item 887, as amended) – insofar as it applies to women born in 1953, who prior to 1 January 2013 acquired the right to the so-called early retirement under Articles 46 and 50 of the said Act – is consistent with Article 2, Article 32(1) as well as Article 67(1) of the Constitution of the Republic of Poland,

 

adjudicates as follows:

Article 25(1b) of the Act of 17 December 1998 on Old-Age and Disability Pensions from the Social Insurance Fund (Journal of Laws – Dz. U. of 2018 item 1270, and of 2019 item 39), in the version that was binding until 30 September 2017 – insofar as it applies to women born in 1953, who prior to 1 January 2013 acquired the right to the so-called early retirement under Article 46 of the said Act – is inconsistent with Article 2 of the Constitution of the Republic of Poland

 

Moreover, the Tribunal decides:

pursuant to Article 59(1)(2) and Article 59(1)(3) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072, and of 2019 item 125), to discontinue the proceedings as to the remainder.

The ruling was unanimous.
