having considered – at the hearing on 9 March 2017, in the presence of the Sejm and the Public Prosecutor-General – a question of law referred by the Voivodeship Administrative Court in Rzeszów: as to whether Article 227 of the Act of 21 August 1997 on the Management of Immovable Property (Journal of Laws – Dz. U. of 2010 No. 102, item 651, as amended) is consistent with Article 2 in conjunction with Article 21(2) and Article 64(1)-(2) of the Constitution of the Republic of Poland,
adjudicates as follows:
Article 227 of the Act of 21 August 1997 on the Management of Immovable Property (Journal of Laws – Dz. U. of 2016, items 2147 and 2260) is consistent with Article 2, Article 21(2), and Article 64(1) of the Constitution of the Republic of Poland.
Moreover, the Tribunal decides:
pursuant to Article 59(1)(2) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072), to discontinue the proceedings as to the remainder.
The ruling was unanimous.
