JUDGMENT
IN THE NAME OF THE REPUBLIC OF POLAND

The Constitutional Tribunal, in a bench composed of:

having considered, at a sitting in camera on 24 October 2017 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. item 2072) – an application lodged by the Ombudsman with the Tribunal to consider the conformity of:

1) Article 13(1)(2), Article 13(2)(1), as well as Article 13(3) of the Act of 13 December 2016 – the Introductory Provisions to the Act on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal and to the Act on the Status of the Judges of the Tribunal (Journal of Laws – Dz. U. item 2074) – insofar as, no later than on 30 September 2017, the employer notifies an employee in writing about the date of the expiry of the employment relationship – to Article 24 and Article 60 of the Constitution of the Republic of Poland;

2) Article 19 of the Act referred to in point 1 above to Article 10, Article 173, Article 190(2) and Article 194(2) of the Constitution;

3) Article 18(2) and Article 21(2) of the Act referred to in point 1 above to Article 190(1) and Article 194(1) of the Constitution;

4) Article 26(2) of the Act of 30 November 2016 on the Status of the Judges of the Constitutional Tribunal (Journal of Laws – Dz. U. item 2073) to Article 173 in conjunction with Article 10(1) of the Constitution as well as Article 195(1) of the Constitution;

5) Article 59(3) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal – insofar as it does not mention review proceedings commenced in a different way than by a constitutional complaint – to Article 5, Article 30, Article 32(1), Article 191(1)(1)‑Article 191(1)(5) in conjunction with Article 188(1)‑Article 188(3) of the Constitution, Article 193, Article 208(1) in conjunction with Article 80 of the Constitution as well as in conjunction with Article 190(4) of the Constitution,

adjudicates as follows:

1. Article 13(1)(2), Article 13(2)(1), as well as Article 13(3) of the Act of 13 December 2016 – the Introductory Provisions to the Act on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal and to the Act on the Status of the Judges of the Tribunal (Journal of Laws – Dz. U. item 2074) are consistent with Article 24 of the Constitution of the Republic of Poland.

2. Article 18(2) and Article 21(2) of the Act referred to in point 1 above – insofar as they concern the judges of the Constitutional Tribunal who were elected by the Sejm of the Republic of Poland and who took the oath of office before the President of Poland – are consistent with Article194(1), first sentence, of the Constitution.

3. Article 19 of the Act referred to in point 1 above is consistent with Article 10, Article 173, and Article 190(2) of the Constitution.

4. Article 26(2) of the Act of 30 November 2016 on the Status of the Judges of the Constitutional Tribunal (Journal of Laws – Dz. U. item 2073) is consistent with Article 173 in conjunction with Article 10(1) of the Constitution as well as with Article 195(1) of the Constitution.

 

Moreover, the Tribunal decides:

pursuant to Article 59(1)(2) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072), to discontinue the proceedings as to the remainder.

The ruling was adopted by a majority vote.
