having considered, at a sitting in camera on 22 May 2019 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. item 2072, as amended) – Ms J.W.’s constitutional complaint lodged with the Tribunal for it to consider the conformity of:

Article 37(1) of the Act of 27 March 2003 on Spatial Planning and Development (Journal of Laws – Dz. U. of 2015 item 199 as amended) – insofar as a decrease in the value of an immovable property refers to the criterion of the actual use of the property during the period of the so-called planning gap, in situations where the use of the property has been specified in a less advantageous way than in a local spatial development plan adopted prior to 1 January 1995 as well as in a less advantageous way than in the study of the determinants and directions of the spatial development of a commune [being the basic unit of local self-government] – to Article 32(1) in conjunction with Article 31(3) and Article 64(2) and (3) as well as to the principles expressed in Article 2 and Article 21(1) of the Constitution of the Republic of Poland,

adjudicates as follows:

Article 37(1) of the Act of 27 March 2003 on Spatial Planning and Development (Journal of Laws – Dz. U. of 2018 item 1945 as well as of 2019 items 60, 235 and 730) – construed in the way that it permits determining less advantageous use of an immovable property than the use provided for in a local spatial development plan adopted prior to 1 January 1995 – is inconsistent with Article 64(2) of the Constitution of the Republic of Poland.

Moreover, the Tribunal decides:

pursuant to Article 59(1)(3) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072 as well as of 2019, item 125), to discontinue the proceedings as to the remainder.

The ruling was unanimous.
