having considered, at a sitting in camera on 19 June 2018 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. item 2072) – the Ombudsman’s application lodged with the Tribunal to consider the conformity of:
Article 14(1), (1a) and (5) of the Act of 20 March 2009 on the Safety of Major Public Events (Journal of Laws – Dz. U. No. 62, item 504, as amended) to Article 2 in conjunction with Article 87(1), Article 73 in conjunction with Article 31(3) and Article 45(1) of the Constitution,
adjudicates as follows:
The provisions of Article 14(1), (1a) and (5) of the Act of 20 March 2009 on the Safety of Major Public Events (Journal of Laws – Dz. U. of 2017, item 1160 as well as of 2018, items 138 and 310) are consistent with Article 87(1) of the Constitution of the Republic of Poland as well as are not inconsistent with Article 45(1) and Article 73 in conjunction with Article 31(3) of the Constitution.
Moreover, the Tribunal decides:
Pursuant to Article 59(1)(2) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072), to discontinue the proceedings as to the remainder.
The ruling was unanimous.
