having considered, at a sitting in camera on 6 June 2018 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. item 2072) – the Ombudsman’s application lodged with the Tribunal to consider the conformity of:
1) Article 33(2b) of the Act of 20 April 2004 on Employment Promotion and Labour Market Institutions (Journal of Laws – Dz. U. of 2016, item 645, as amended) – insofar as it does not provide for an adequate means of appeal against the determination of the type of assistance to be allocated to an unemployed person – to Article 78 in conjunction with Article 45(1) of the Constitution, as well as to Article 13 in conjunction with Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms, done at Rome on 4 November 1950 (Journal of Laws – Dz. U. of 1993 No. 61, item 284, as amended),
2) Article 34a(3c) of the Act referred to in point 1 to Article 47 as well as Article 51(1) and (5) in conjunction with Article 31(3) as well as to Article 92(1) of the Constitution,
3) § 2(2) and (3) of the Regulation of 14 May 2014 by the Minister of Labour and Social Policy with regard to adjusting assistance to the individual needs of unemployed persons (Journal of Laws – Dz. U. item 631) to Article 47 as well as Article 51(1) and (5) in conjunction with Article 31(3) of the Constitution,
adjudicates as follows:

1. Article 33(2b) of the Act of 20 April 2004 on Employment Promotion and Labour Market Institutions (Journal of Laws – Dz. U. of 2017 item 1065, 1292, 1321, 1428, 1543, 2371 and 2494 as well as of 2018, items 107, 138, 650, 730 and 858) – insofar as it does not provide for a separate means of appeal against the determination of the type of assistance to be allocated to an unemployed person – is consistent with Article 45(1) and Article 78 of the Constitution of the Republic of Poland.
2. Article 34a(3c) of the Act referred to in point 1 is inconsistent with Article 51(1) and (5) in conjunction with Article 31(3) as well as with Article 92(1) of the Constitution.

The provision mentioned in part I in point 2 will cease to have effect after the lapse of 12 (twelve) months from the date of the publication of the judgment in the Journal of Laws of the Republic of Poland.
Moreover, the Tribunal decides:
Pursuant to Article 59(1)(3) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072), to discontinue the proceedings as to the remainder.
The ruling was unanimous.
