having considered, at a hearing on 26 June 2018 – in the presence of the complainant, the Sejm and the Public Prosecutor-General – a constitutional complaint lodged by Ms B. S. with the Tribunal to consider the conformity of:
Article 2(1) of the Act of 22 May 2009 on Teachers’ Compensatory Benefits (Journal of Laws – Dz. U. No. 97, item 800, as amended) – insofar as it does not mention psychologists employed in educational counselling centres among persons who are eligible for teachers’ compensatory benefits – to Article 67(1) in conjunction with Article 32(1) as well as to Article 67(1) in conjunction with Article 2 of the Constitution,
adjudicates as follows:
Article 2(1) of the Act of 22 May 2009 on Teachers’ Compensatory Benefits (Journal of Laws – Dz. U. of 2018, item 128) – insofar as it does not mention psychologists employed in educational counselling centres among persons who are eligible for teachers’ compensatory benefits – is consistent with Article 67(1) in conjunction with Article 32(1) and Article 2 of the Constitution of the Republic of Poland.
The ruling was unanimous.
