having considered, at a sitting in camera on 13 November 2018 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. item 2072) – a constitutional complaint of the company called 'Salag sp. z o.o. sp.k.' (having its registered office in Suwałki), lodged with the Tribunal for it to consider the conformity of:


Article 30i(1) of the Act of 6 December 2006 on the Terms of Implementing the Policy of Development (Journal of Laws – Dz. U. of 2014 item 1649, as amended) to Article 78 in conjunction with Article 2 in conjunction with Article 32(1) and (2) in conjunction with Article 31(3) of the Constitution,

adjudicates as follows:

Article 30i(1) of the Act of 6 December 2006 on the Terms of Implementing the Policy of Development (Journal of Laws – Dz. U. of 2018 items 1307 and 1669) is consistent with Article 78 in conjunction with Article 31(3), in conjunction with Article 2, in conjunction with Article 32(1) and (2) of the Constitution of the Republic of Poland.

The ruling was unanimous.
