having considered, at hearings on 30 October and 13 November 2018 – in the presence of the applicant, the Sejm and the Public Prosecutor-General – an application of the President of the Republic of Poland filed with the Tribunal in accordance with Article 122(3) of the Constitution of the Republic of Poland for the Tribunal to consider the conformity of:

the Act of 15 December 2017 amending the Act on the Social Insurance System and certain other acts to Article 2, Article 7 as well as Article 59(2) in conjunction with Article 12 and Article 20 of the Constitution of the Republic of Poland,

adjudicates as follows:

The Act of 15 December 2017 amending the Act on the Social Insurance System and certain other acts:

a) is consistent with Article 2 of the Constitution of the Republic of Poland;

b) is inconsistent with Article 7 of the Constitution.

Moreover, the Tribunal decides:

pursuant to Article 59(1)(2) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072), to discontinue the proceedings as to the remainder.
