having considered, at a hearing on 20 April 2020 – in the presence of the applicant and the Public Prosecutor-General – the Prime Minister’s application lodged with the Constitutional Tribunal to consider the Supreme Court’s resolution of 23 January 2020, ref. no. BSA I 4110 1/20 – issued jointly by the Court’s Civil Chamber, Criminal Chamber, as well as Labour Law and Social Security Chamber – in terms of the conformity of the resolution to:

1) Art. 83(1) of the Supreme Court Act of 8 December 2017 (Journal of Laws – Dz. U. of 2019, item 825, as amended),

2) Art. 439(1)(2) of the Criminal Procedure Code of 6 June 1997 (Journal of Laws – Dz. U. of 2020 item 30),

3) Art. 379(4) of the Civil Procedure Code of 17 November 1964 (Journal of Laws – Dz. U. of 2019 item 1460, as amended),

4) Art. 47 of the Charter of Fundamental Rights of the European Union (OJ C 202, 7.6.2016, pp. 391–407),

5) Art. 6(1) of the Convention for the Protection of Human Rights and Fundamental Freedoms, done at Rome on 4 November 1950 (Journal of Laws – Dz. U. of 1993 No. 61, item 284),

6) Art. 2 and Art. 4(3) of the Treaty on European Union (consolidated version, OJ C 202, 7.6.2016, pp. 13–388(EN)),

7) Art. 179, Art. 144(3)(17), Art. 183(1), Art. 45(1), Art. 8(1), Art. 7 and Art. 2 of the Constitution of the Republic of Poland,

adjudicates as follows:

The Supreme Court’s resolution of 23 January 2020 (ref. no. BSA I 4110 1/20, OSNKW no. 2/2020, item 7), issued jointly by the Court’s Civil Chamber, Criminal Chamber, as well as Labour Law and Social Security Chamber, is inconsistent with:

a) Art. 179, Art. 144(3)(17), Art. 183(1), Art. 45(1), Art. 8(1), Art. 7 and Art. 2 of the Constitution of the Republic of Poland,

b) Art. 2 and Art. 4(3) of the Treaty on European Union (consolidated version, OJ C 202, 7.6.2016, pp. 13–388(EN)),

c) Art. 6(1) of the Convention for the Protection of Human Rights and Fundamental Freedoms done at Rome on 4 November 1950, subsequently amended by the Protocols Nos. 3, 5 and 8 as well as supplemented by the Protocol No. 2 (Journal of Laws – Dz. U. of 1993 No. 61, item 284, as amended).

Moreover, the Tribunal decides:

pursuant to Article 59(1)(2) and Article 59(1)(3) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. of 2019, item 2393), to discontinue the proceedings as to the remainder.

The ruling was adopted by a majority vote.
