The Constitutional Tribunal, composed of:

having considered, at a sitting in camera on 25 August 2020 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. of 2019, item 2393) – the joined constitutional complaints of 5 May and 17 August 2015 filed, by the company referred to as ‘M. SA’, for the Tribunal to consider the conformity of:

1) Article 54(5) and Article 54(6) (insofar the latter refers to the former) of the Medical Activity Act of 15 April 2011 (Journal of Laws – Dz. U. of 2013 item 217, as amended) – insofar as they concern juridical acts which are performed in the course of carrying out economic activity and which result in assuming the legal rights of the creditor – with Article 20 and Article 22 in conjunction with Article 31(1) and Article 31(2), second sentence, as well as Article 31(3), and also with Article 64(1) in conjunction with Article 31(3) of the Constitution,

2) Article 54(5) and Article 54(6) of the Act referred to in point 1 – insofar as they provide for the invalidity of juristic acts resulting in the statutory subrogation under Polish law – with Article 22 in conjunction with Article 20, Article 31(3) and Article 2, with Article 64(1) in conjunction with Article 31(3) and Article 2, with Article 64(2) in conjunction with Article 32 and Article 2 as well as with Article 78 of the Constitution,

adjudicates as follows:

Article 54(5) in conjunction with Article 54(6) of the Medical Activity Act of 15 April 2011 (Journal of Laws – Dz. U. of 2020 items 295 and 567) is consistent with Article 31(1) and (2), second sentence, in conjunction with Article 31(3) of the Constitution of the Republic of Poland.

Moreover, the Tribunal decides:

to discontinue the proceedings as to the remainder.

The ruling was unanimous.
