having considered, at a sitting in camera on 4 June 2024 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. of 2019, item 2393) – Mr T.K.’s constitutional complaint lodged with the Constitutional Tribunal to examine the conformity of:
Article 25(1b) of the Act of 17 December 1998 on Old-Age and Disability Pensions from the Social Insurance Fund (Journal of Laws – Dz. U. of 2018, item 1270, as amended) – insofar as “it concerns persons who, prior to 1 January 2013, acquired the right to an old-age pension on the basis of Article 32 of the said Act” – with Article 67(1) in conjunction with Article 2 of the Constitution,
adjudicates as follows:
Article 25(1b) of the Act of 17 December 1998 on Old-Age and Disability Pensions from the Social Insurance Fund (Journal of Laws – Dz. U. of 2023, item 1251) – insofar as it concerns persons who submitted their applications for the benefits referred to in that provision prior to 6 June 2012 – is inconsistent with Article 67(1) in conjunction with Article 2 of the Constitution of the Republic of Poland.
Moreover, the Tribunal decides:
to discontinue the proceedings as to the remainder.
The ruling was adopted by a majority vote.
