JUDGMENT
IN THE NAME OF THE REPUBLIC OF POLAND

The Constitutional Tribunal, composed of:

having considered, at the hearing on 10 September 2024 – in the presence of the applicant – the application by a group of Sejm Deputies lodged with the Constitutional Tribunal to consider the conformity of:

(1) Article 2 of the resolution of 17 January 2024 by the Sejm of the Republic of Poland on the appointment of the Inquiry Committee to examine the legality, appropriateness, and purposefulness of operational and investigative activities undertaken, inter alia, with the use of Pegasus software by the members of the Council of Ministers, the secret service, the Police, tax and customs authorities, law enforcement authorities, and the public prosecution service during the period from 16 November 2015 to 20 November 2023 (Official Gazette – Monitor Polski (M. P.) item 70) with Article 2 and Article 111(1) of the Constitution of the Republic of Poland;

(2) Article 2(1), (3) and (6) of the resolution referred to in point 1 with Article 10 and Article 95(2) of the Constitution of the Republic of Poland;
 

adjudicates as follows:

Article 2 of the resolution of 17 January 2024 by the Sejm of the Republic of Poland on the appointment of the Inquiry Committee to examine the legality, appropriateness, and purposefulness of operational and investigative activities undertaken, inter alia, with the use of Pegasus software by the members of the Council of Ministers, the secret service, the Police, tax and customs authorities, law enforcement authorities, and the public prosecution service during the period from 16 November 2015 to 20 November 2023 (Official Gazette – Monitor Polski (M. P.) item 70) is inconsistent with Article 2 of the Constitution of the Republic of Poland.

 

Moreover, the Tribunal decides:

to discontinue the proceedings as to the remainder.

The ruling was unanimous.
