having considered, at a sitting in camera on 16 February 2017 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. item 2072) – an application by the National Council of Notaries Public to determine the conformity of:
§ 8(5) of the Regulation of 17 December 2013 issued by the Minister of Justice with regard to the organisation and course of legal training for trainee notaries (Journal of Laws – Dz. U., item 1668), insofar as it provides for the possibility of making up for absences by trainee notaries after the date of the completion of the legal training, to Article 72(1) and Article 75 of the Act of 14 February 1991 on Notaries Public (Journal of Laws – Dz. U. 2014, item 164),
adjudicates as follows:
§ 8(5), second sentence, of the Regulation of 17 December 2013 issued by the Minister of Justice with regard to the organisation and course of legal training for trainee notaries (Journal of Laws – Dz. U., item 1668) is consistent with Article 72(1), first sentence, and Article 75 of the Act of 14 February 1991 on Notaries Public (Journal of Laws – Dz. U. 2014, items 1796, 2175 and 2261).
Moreover, the Tribunal decides:
pursuant to Article 59(1)(2) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U., item 2072), to discontinue the proceedings as to the remainder.
