having considered, at a sitting in camera on 25 April 2017 – in accordance with Article 92(1)(1) of the Act of 30 November 2016 on the Organisation of the Constitutional Tribunal and the Mode of Proceedings Before the Constitutional Tribunal (Journal of Laws – Dz. U. item 2072) – a question of law referred by the District Court in Gliwice:

as to whether Article 18(7) of the Act of 25 June 1999 on social insurance benefits in the event of an illness or maternity (Journal of Laws – Dz. U. of 2014, item 159), insofar as the provision deprives an insured person – who has the right to an old-age pension, the payment of which was suspended due to the continuation of employment, and where the said right had been determined by a decision of an authority competent within the scope of disability pensions – of a rehabilitation benefit, is consistent with Article 2 in conjunction with Article 67(1) of the Constitution of the Republic of Poland

adjudicates as follows:

Article 18(7) of the Act of 25 June 1999 on social insurance benefits in the event of an illness or maternity (Journal of Laws – Dz. U. of 2016 item 372, 960, 1265, 1579 and 2020 as well as of 2017 item 396), insofar as the provision eliminates the possibility of granting a rehabilitation benefit to an insured person who has the right to an old-age pension, the payment of which was suspended due to the continuation of employment, and where the said right had been determined by a decision of an authority competent within the scope of disability pensions, is consistent with Article 67(1) in conjunction with Article 2 of the Constitution of the Republic of Poland.
