JUDGMENT

having considered, at the hearing on 6 March 2025 – in the presence of the applicant – the application by the National Council of the Judiciary lodged with the Constitutional Tribunal for it to consider the conformity of:
(1) the Minister of Justice’s Regulation of 26 September 2024 amending the Regulation on the Rules of Procedure for Common Courts (Journal of Laws – Dz. U. item 1444) with Article 41(1) of the Act of 27 July 2001 on the Organisational Structure of Common Courts (Journal of Laws – Dz. U. of 2024, item 334), and thus with Article 2, Article 7 in conjunction with Article 186(1) and Article 92(1) of the Constitution of the Republic of Poland,
(2) § 2 of the Regulation referred to in point 1 with Article 41(1) of the Act referred to in point 1, and thus with Article 92(1), Article 176(2) and Article 178(1) of the Constitution,
adjudicates as follows:
(1) the Minister of Justice’s Regulation of 26 September 2024 amending the Regulation on the Rules of Procedure for Common Courts (Journal of Laws – Dz. U. item 1444) is inconsistent with Article 2, Article 7 in conjunction with Article 186(1) and Article 92(1) of the Constitution of the Republic of Poland.
(2) § 2 of the Regulation referred to in point 1 is inconsistent with Article 176(2) and Article 178(1) of the Constitution.
Moreover, the Tribunal decides:
to discontinue the proceedings as to the remainder.
