Credit cooperatives’ obligations to maintain the minimum requirement for own funds and eligible liabilities, as set by the Bank Guarantee Fund K 13/22
On 10 December 2025, the Constitutional Tribunal was to consider the Public Prosecutor-General’s application concerning credit cooperatives’ obligations to maintain the minimum requirement for own funds and eligible liabilities, which had been set by the Bank Guarantee Fund.
The Tribunal decided to discontinue the proceedings as, at the hearing on 10 December 2025, neither the applicant (i.e. the Public Prosecutor-General) nor a representative thereof was present, despite having been properly notified of the date and time of the hearing.
The ruling was unanimous.
The adjudicating panel in the case comprised the following judges of the Constitutional Tribunal: Judge Wojciech Sych as the Presiding Judge; Judge Andrzej Zielonacki as the Judge Rapporteur; the President of the Constitutional Tribunal, Judge Bogdan Święczkowski; Judge Rafał Wojciechowski; and Judge Jarosław Wyrembak.
