JUDGMENT
IN THE NAME OF THE REPUBLIC OF POLAND

The Constitutional Tribunal, composed of:

having considered, at a hearing on 28 May 2024 – in the presence of the applicants and the representative of the Sejm – the application by a group of Sejm Deputies lodged with the Constitutional Tribunal to consider the conformity of:

the resolution of 6 March 2024 adopted by the Sejm of the Republic of Poland with regard to eliminating the effects of the 2015-2023 constitutional crisis in the context of the activity of the Constitutional Tribunal (Official Gazette – Monitor Polski (M. P.), item 198) – insofar as it comprises certain provisions of law – with Article 4, Article 104(1) in conjunction with Article 106 and Article 96(1), as well as with Article 7, Article 87, Article 173 in conjunction with Article 10 and Article 190(1) of the Constitution of the Republic of Poland,

adjudicates as follows:

The resolution of 6 March 2024 adopted by the Sejm of the Republic of Poland with regard to eliminating the effects of the 2015-2023 constitutional crisis in the context of the activity of the Constitutional Tribunal (Official Gazette – Monitor Polski (M. P.), item 198) is inconsistent with Article 7 in conjunction with Article 87(1), Article 10 in conjunction with Article 173 and Article 190(1) of the Constitution of the Republic of Poland.

Moreover, the Tribunal decides:

to discontinue the proceedings as to the remainder.

The ruling was unanimous.
