having considered, at the hearings on 1 October and 3 December 2025 – in the presence of the applicant and the National Committee of the Communist Party of Poland – the joined applications by the Public Prosecutor-General and the President of the Republic of Poland, lodged with the Constitutional Tribunal for it to consider the conformity of:
(1) the purposes of the political party called Komunistyczna Partia Polski (En. the Communist Party of Poland), which has been entered in the register of political parties under the reference number EwP 152 – where the said purposes comprise not only the purposes set out in the Preamble as well as Article 57(1) and (2) of the Rules and Regulations of the Communist Party of Poland (adopted in Dąbrowa Górnicza in July 2002) and the Manifesto of the Communist Party of Poland (adopted at the said Party’s 4th convention in Dąbrowa Górnicza in December 2015), but also the purposes arising from the said Party’s activity envisaged in the Manifesto – to Article 13 in conjunction with Article 11(1), second sentence, of the Constitution, due to references made in the manifesto goals to communist totalitarian methods and practices as well as due to the assumption about resorting to violence as a means of taking over power and impacting the state’s policies;
(2) the activity of the Communist Party of Poland – as revealed in references made in political publications, statements and other forms of political activism to communist totalitarian methods and practices as well as in presenting the assumption about resorting to violence as a means of taking over power and impacting the state’s policies – to Article 13 in conjunction with Article 11(1), second sentence, of the Constitution,
adjudicates as follows:
The purposes and activity of the Communist Party of Poland are inconsistent with Article 13 in conjunction with Article 11(1), second sentence, of the Constitution of the Republic of Poland.
Moreover, the Tribunal decides:
to discontinue the review proceedings within the application of the Public Prosecutor-General.
The ruling was unanimous.
